Edit the image page.

Add {{pui|log=2008 July 6}} to the image page. If the image is in use, also add {{puic|Image:Image_name.ext|log=2008 July 6}} to the caption(s).

Create its PUI subsection.

Follow this edit link and list the image at the bottom of that page using {{subst:pui2|image=Image_name.ext|reason=reason}} — ~~~~. (remember to exclude the Image: prefix).

III
Give due notice.

Inform the uploader by adding a message to their talk page using {{subst:idw-pui|Image:Image_name.ext}}

Remember to replace "Image_name.ext" with the name of the image or media

Unlike Wikipedia:Images and media for deletion the primary purpose of this page is to ascertain the source and/or copyright status of an image. Therefore it is not specifically a vote to keep or delete but a forum for the exploration of the copyright status/source of an image and contributions should not be added solely in those terms.

Listings should be processed by an administrator after being listed for 14 days. Images that are accepted following this fourteen-day period should have {{subst:puir}} added to the image talk page and a copy of the issue and/or discussion that took place here put on the image talk page as well.

Note: Images can be unlisted immediately if they are indisputably in the public domain or licensed under an indisputably free license (GFDL, CC-BY-SA, etc.—see Wikipedia:Image copyright tags for more on these). Images which claim fair use must have two people agree to this.

The image has a notice saying that it is fair use in the US and public domain in Canada. The fair use rationale makes sense, so it is logical for the image to remain on Wikipedia. But the justification for saying that it is public domain in Canada is that it is a "Canadian image" either made before 1949 or else subject to an expired crown copyright. Yet the description says that it shows the ship in Detroit (not in Canada), and according to the article on the Noronic, the ship was in Detroit in 1949, so the image could date from 1949 even though the ship was destroyed later that year. And no source is given to suggest that crown copyright would apply. So while the use of the image is legitimate based on US fair use, the Canadian status is suspicious. Incidentally, I see that the same contributor has uploaded other images of the Noronic which have been deleted. — 207.176.159.90 (talk) 01:21, 27 June 2008 (UTC).

Thanks for writing the nomination, Stewie. Moe Berg played for the Princeton Tigers baseball team well into 1923, which means the image might not meet the requirements for public domain in the United States. According to the Princeton University Library, Berg was Class of '23 and was captain of the baseball team his senior year -- which I presume was during Spring 1923.[4] I believe the img was taken from the book The Catcher Was a Spy; it might indicate what year it was taken, or whether it was a picture of Berg as team captain. The user created the image as a screen cap from a security video tape from the Alabama State House. The only copyright issue is whether there is copyright in the original video from which it is a derivative work. The tape was merely left on, to be recorded over if nothing happened, and presumably retrieved if someone got shot in the chamber. As such, it lacks the requisite "creativity" to be afforded copyright protection for the only potential claimant, the State of Alabama. In the case deciding the copyright in the famous "Zapruder Film" of the Kennedy assassination, it was held that Zapruder had copyright because he was consciously aiming and operating the camera at the time, selecting the subject, content, framing and duration. The court stated that for copyright to attach, "It undoubtedly requires originality to determine just when to take the photograph, so as to bring out the proper setting for both animate and inanimate objects, with the adjunctive features of light, shade, position, etc." Time, Inc. v. Bernard Geis Assoc., 293 F.Supp. 130 (S.D.N.Y. 1968). Now, if a video artist set up a camera in Times Square to tape eight hours in the life of the Square, just to "capture the ambience" or whatever, for a calculated artistic effect, that would be a closer case.
The anonymous staffer who stuck a tape in the recorder, resulting in this image, lacked that "orginality" or "creative intent" to make it copyrightable. It is no more copyrightable than the security video of a convenience store.
There is a second issue, which Wiki policy doesn't handle well, which is the issue of indisputably waived copyright. If I have copyright in a book, picture, or whatever, and I knowingly allow its reproduction, I have abandoned my copyright. That would be the case here, even if the original work were copyrighted.
The image was formerly posted in an article about the subject of the image. The article is currently in something of an edit war, with a handful of admins providing informal mediation. Some editors claim the image is NOPV as overly negative and should be excluded; others that the underlying video has independent historical/notablility significance and should be included. It remains unclear what result will obtain.

I had brought up some concerns to the uploader previously. This page states, "On this page you will find photos, videos and audio materials that could be useful for your stories.
